The dream that the African Democratic Congress, ADC, would be the new big tent for the opposition to unseat President Bola Tinubu in 2027 suffered a fatal blow this morning at the Federal High Court in Abuja.

In a thunderous judgment that has sent shockwaves through the political class, Justice Peter Lifu sacked the entire Senator David Mark-led executives of the ADC and declared every single action they took as illegal, null and void.

And at the centre of that illegality: the much-hyped nomination of former Vice President Atiku Abubakar as the ADC presidential candidate for 2027.

THE JUDGMENT
Justice Lifu, delivering judgment in suit FHC/ABJ/CS/1819/2025 filed by the aggrieved former National Deputy Chairman, North-East, Nafiu Bala Gombe, held that the Mark-led Caretaker Committee was unconstitutionally constituted.

The plaintiff had asked the court to restrain Senator David Mark and Ogbeni Rauf Aregbesola from parading themselves as National Chairman and Secretary of ADC, insisting that their emergence violated the party’s constitution and the Electoral Act.

The court agreed.

Justice Lifu not only sacked Mark and Aregbesola, but declared that the primary election they organised which produced Atiku Abubakar as ADC flagbearer was conducted without legal foundation and therefore cannot stand. INEC was barred from recognising any product of that leadership.

Listed as defendants were ADC, INEC, Senator Mark, Aregbesola and Chief Ralph Nwosu.

ADC immediately vowed to appeal.

A PARTY AT WAR WITH ITSELF
This is not a new crisis. It is the climax of a legal war that has turned ADC into a court party.

On April 29, 2026, Justice Joyce Abdulmalik nullified all state congresses organised by Mark’s caretaker committee and restrained INEC from recognising them, insisting elected state executives must be allowed to complete their tenure.

On July 13, 2026, the Court of Appeal, in a split 2-1 judgment led by Justice Okon Abang, upheld Abdulmalik’s decision and declared that the Mark-led convention was conducted in disobedience to a subsisting court order and was therefore null and void.

Yet, in a conflicting twist, another Federal High Court had earlier affirmed Mark’s leadership as valid.

Today’s judgment is the most devastating yet, because it goes to the root: it sacks the leadership itself and voids Atiku’s candidacy directly.

HOW THIS SHATTERS ATIKU’S 2027 DREAM
For Atiku Abubakar, this is more than a legal setback. It is a political earthquake.

  1. Candidacy Voided: Atiku, who dumped PDP and was adopted as ADC presidential candidate in a colourful ceremony in July, is now legally not a candidate of any party. The platform upon which he was standing has been declared non-existent in law.
  2. Time Is Running: INEC has fixed presidential election for January 16, 2027. Party primaries must be concluded and submitted months before. Atiku does not have the luxury of starting afresh. If appeal fails, he must find a new party, conduct fresh primaries, and battle INEC timelines.
  3. The Coalition Dream Is Dead: The entire opposition coalition – Atiku, Obi, El-Rufai, Amaechi, Aregbesola – had agreed to adopt ADC as the special purpose vehicle to challenge APC. David Mark and Aregbesola were brought in as caretaker Chairman and Secretary to midwife that coalition. If their leadership is illegal, everything built on it collapses. Obi’s camp already distrusts Atiku’s dominance. This judgment will deepen that distrust.
  4. Seventh Attempt in Limbo: Atiku has contested for President since 1993 – 1993, 2007, 2011, 2015, 2019, 2023. 2027 was to be his seventh attempt, his final shot. To have it voided not by voters, but by a Federal High Court judgment on party structure, is the cruelest twist in his long political journey.
  5. The Law Mefor Prophecy Comes True: Just last week, Law Mefor said, “Nowhere in history has a divided opposition ever upstaged a determined incumbent.” Today, the divided opposition cannot even agree on who is their National Chairman. How can they unseat a sitting President who controls all levers of power?

WHAT NEXT?
Legally, ADC will head to the Court of Appeal. Politically, Atiku has three painful options:

Option A: Stay in ADC and hope Appeal Court reverses Lifu within 30 days – a gamble, given that Appeal Court had earlier upheld nullification of Mark’s congresses.

Option B: Return to PDP and fight for its ticket – but PDP is already in Wike’s grip and has zoned its ticket.

Option C: Hunt for a new party – SDP, LP, or NNPP – but each has its own owner who will not surrender ticket easily to Atiku.

For a man who won his ADC ticket unopposed, the irony is bitter: the man who had no opponent at the convention is now left with no party after the court.

In Sokoto yesterday, they celebrated a massive turnout. In Abuja today, the court has told them the celebration had no legal leg to stand on.

Politics is not motorcade. Politics is structure. And today, the structure of ADC was declared illegal.

The 2027 race just changed.
